Problems arise very often when a balcony’s waterproofing is damaged or deteriorates, causing water ingress problems into the apartment or dwelling below. The question is, who pays?
If you live in a complex run by a body corporate, the waterproofing is installed to protect the property underneath, not to benefit the balcony. Often the problems caused by water ingress issues from a balcony are through no fault of either owner. It is however, often a result of poor design or workmanship by the developer or building contractor trying to reduce costs at the time of construction.
Defective waterproofing can cause water to seep through the screed and slab within the balcony floor, and into the unit below causing damage to the ceiling, plaster, paint work and encouraging mould growth.
Fixing the leaking balcony includes lifting all the tiles on the balcony floor and walls (if there is a skirting tile), removing the old waterproofing and installing a new waterproofing system. Another consideration to keep in mind is the type of slab that the balcony is cast from(Cast-in-situ or block & rib slab). Certain waterproofing systems cannot be used on the block & rib slab system. Afterwards, reinstalling new tiles and grouting.
But all of that costs money. So, who pays?
Well, unless you have made an agreement with the “owner” of the balcony deck that is leaking, the cost is evenly shared between the 2 units.
